Terms of Service
Rules, conditions, and legal terms governing your use of TheFitGam3.

1. Acceptance of these terms
By creating an account, accessing, subscribing to, or using TheFitGam3, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not use the service.
2. Eligibility
You may only use TheFitGam3 if you are legally capable of entering into a binding agreement under the law that applies to you. If you are under 18, you must only use the service with any permission, supervision, or consent required by applicable law or by your parent or legal guardian.
3. Nature of the service
TheFitGam3 is a digital fitness and gamified activity platform. It may provide workout structures, activity tracking, progression systems, challenges, squads, leaderboards, and similar features. The service is intended for informational, motivational, entertainment, and self-tracking purposes only.
TheFitGam3 does not provide medical care, diagnosis, treatment, or other regulated healthcare services.
4. Health and safety disclaimer
Physical exercise and fitness activity involve inherent risks, including the risk of injury, illness, or other harm. You participate in any workout, challenge, or activity at your own risk and are solely responsible for your own health decisions, physical condition, and participation.
You should consult a qualified healthcare professional before starting any new exercise, nutrition, or wellness programme, especially if you have any medical condition, injury, symptoms, or other health concern.
5. Accounts and account security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate information where required and keep your account details reasonably up to date.
You must not share your account, impersonate another person, or access the service in an unauthorised manner.
6. Subscriptions, trials, and billing
Certain features of TheFitGam3 may require a paid subscription. Payments, subscription checkout, and related billing processes are handled by Stripe or another payment provider used by us from time to time.
Paid subscriptions may renew automatically unless cancelled before the applicable renewal date.
If a trial is offered, it may convert automatically into a paid subscription unless cancelled before the trial ends.
You are responsible for managing your subscription and cancellation before renewal if you do not wish to continue.
Refunds, if any, are only provided where required by applicable law or at our discretion.
7. Beta features and service availability
TheFitGam3 may operate in beta, early access, preview, or evolving release states. Features may change, be suspended, contain bugs, or be removed at any time. We do not guarantee uninterrupted availability, error-free operation, or permanent availability of any feature, challenge, leaderboard, reward, or progression mechanic.
8. Acceptable use
You agree not to:
Cheat, exploit, manipulate, or falsify workouts, scores, XP, or leaderboard results;
Abuse, harass, threaten, or target other users or community members;
Upload, submit, or share unlawful, abusive, hateful, or deceptive content;
Attempt to reverse engineer, disrupt, probe, attack, or interfere with the platform;
Bypass payments, access controls, security measures, or subscription restrictions; or
Use the service in a way that violates applicable law or the rights of others.
9. Challenges, leaderboards, XP, and virtual progression
TheFitGam3 may include points, XP, levels, badges, rankings, streaks, challenge outcomes, leaderboards, and other progression or reward mechanics. These are part of the service experience only. Unless expressly stated otherwise, they have no cash value, are not property, and may be adjusted, reset, removed, corrected, or withdrawn at any time where reasonably necessary.
We reserve the right to investigate suspicious activity and to remove, correct, invalidate, or refuse any score, submission, reward, or ranking where we believe misuse, error, fraud, exploitation, or rule-breaking has occurred.
10. Intellectual property
TheFitGam3, including its name, branding, logos, designs, software, text, graphics, audiovisual content, game mechanics, and platform content, is owned by us or our licensors and is protected by applicable intellectual property laws.
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the service for its intended personal use only, subject to these Terms.
11. Suspension and termination
We may suspend, restrict, or terminate your access to all or part of the service at any time if we reasonably believe that you have breached these Terms, abused the platform, created risk for us or other users, failed to pay amounts due, or attempted to interfere with the service, payments, or security controls.
You may stop using the service at any time. Termination or suspension does not automatically entitle you to a refund unless required by law.
12. Limitation of liability
To the maximum extent permitted by applicable law, TheFitGam3 and its officers, affiliates, personnel, contractors, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, use, opportunity, or business arising out of or in connection with your use of, or inability to use, the service.
To the maximum extent permitted by law, we are also not responsible for any injury, loss, damage, or adverse outcome arising from your participation in any fitness activity, workout, challenge, or recommendation accessed through the platform.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
13. Privacy
Your use of TheFitGam3 is also subject to our Privacy Policy, which explains how we collect, use, and protect personal data.
14. Changes to the service or these terms
We may update, modify, suspend, or discontinue any part of the service at any time. We may also update these Terms from time to time. Where appropriate, we will update the effective date above and take reasonable steps to notify users of material changes. Your continued use of the service after updated Terms take effect means you accept the revised Terms.
15. Governing law
These Terms and any non-contractual disputes or claims arising out of or in connection with them or the service shall be governed by the laws of England and Wales, unless mandatory law in your place of residence requires otherwise.
