How TheFitGam3 collects, uses, shares, and protects your personal data.

1. Who we are

TheFitGam3 (“we”, “us”, “our”) operates a gamified fitness platform that allows users to create an account, complete workouts, track activity, join squads, participate in challenges, and view progression through features such as XP, streaks, and leaderboards.

For the purposes of applicable data protection law, including the UK GDPR, we act as the data controller for the personal data we collect and process through the platform.

2. Personal data we collect

  • Account data: email address, username, authentication identifiers, and account settings.

  • Profile data: optional profile information you choose to provide, such as fitness goals, fitness level, height, weight, avatar settings, and similar profile inputs.

  • Activity and performance data: workouts completed, challenge participation, Body Sync task completions, XP, streaks, leaderboard entries, scores, and other progression-related data.

  • Community data: squad membership, challenge submissions, leaderboard positioning, and other in-app social or competitive participation data.

  • Device and usage data: app usage information, log data, diagnostics, browser/device data, and basic technical performance information used to maintain security and improve stability.

  • Payment and subscription data: subscription status, billing state, and limited payment-related metadata. Full card details are processed by our payment provider and are not stored by us.

Some information processed through the platform, particularly workout, activity, performance, and certain profile data, may constitute data concerning health or other health-related personal data under applicable law.

3. How we use your data

  • To create and manage your account.

  • To provide the app and its core features.

  • To track workouts, progression, XP, streaks, challenge activity, and leaderboard participation.

  • To operate squads, community features, and competition mechanics.

  • To maintain platform security, prevent abuse, investigate misuse, and enforce our rules and subscription controls.

  • To provide support, respond to requests, and communicate important service updates.

  • To monitor, troubleshoot, improve, and develop the platform and user experience.

4. Our legal bases for processing

We rely on one or more of the following legal bases where applicable:

  • Contract: where processing is necessary to provide the service you requested, including account creation, subscription access, and core app functionality.

  • Legitimate interests: where processing is necessary for security, fraud prevention, service administration, diagnostics, product improvement, and enforcing our terms, provided those interests are not overridden by your rights.

  • Consent: where required for optional features, optional communications, or other processing that depends on your permission.

  • Explicit consent: where required for the processing of health-related data or other special category data, if and to the extent applicable.

5. Health-related data

TheFitGam3 is a fitness platform. By using features that record workouts, performance, activity, goals, or similar inputs, you understand that we may process health-related data in order to provide those features to you.

We do not provide medical care, medical diagnosis, or medical treatment, and the app is not a substitute for professional medical advice.

6. Payments and subscription processing

Payments and subscriptions are processed by Stripe. We do not store your full card details. Stripe may process your payment data in accordance with its own privacy policy and legal obligations.

7. Sharing your data

We do not sell your personal data. We may share personal data only where necessary with trusted service providers that help us operate the platform, such as providers of hosting, infrastructure, authentication, analytics, customer support, and payment processing.

We may also disclose data where required to comply with legal obligations, protect our rights, investigate misuse, or enforce our terms.

8. International transfers

Some of our service providers may process personal data outside the UK or EEA. Where this happens, we take steps intended to ensure appropriate safeguards are in place, such as contractual protections or reliance on lawful transfer mechanisms where available.

9. Data retention

We retain personal data for as long as reasonably necessary to operate the service, maintain your account, comply with legal obligations, resolve disputes, prevent fraud or abuse, and enforce our agreements.

If you request deletion of your account, we will delete or anonymise personal data where reasonably possible, except where retention is required for legal, regulatory, fraud prevention, security, or legitimate business purposes.

10. Your rights

Depending on your location and the applicable law, you may have rights to:

  • request access to your personal data;

  • request correction of inaccurate or incomplete data;

  • request deletion of your personal data;

  • request restriction of certain processing;

  • object to certain processing;

  • withdraw consent where processing is based on consent; and

  • request portability of certain data where applicable.

We aim to respond to valid privacy requests within the time required by applicable law, which is typically within 30 days.

11. Security

We use appropriate technical and organisational measures designed to protect personal data against unauthorised access, loss, misuse, or alteration. However, no platform, service, or transmission method is completely secure, and we cannot guarantee absolute security.

You are responsible for maintaining the confidentiality of your account credentials and for using the platform responsibly.

12. Children

TheFitGam3 is not intended for anyone who is not legally permitted to use the service under applicable law or our Terms. If you believe personal data has been provided to us improperly, contact us so we can review and take appropriate action.

13. Changes to this policy

We may update this Privacy Policy from time to time. Where appropriate, we will update the effective date above and take reasonable steps to notify users of material changes.
